When you buy a home, or any real estate, the property is transferred through an instrument called a deed. The deed sets forth the legal description of your property by providing the meets and bounds of the boundary of the real estate you own. What Is Title Insurance, And Do You Need It?

Title insurance is insurance issued on the title of your real estate. That sounds redundant, but it is something that, in many instances, will protect landowners from being sued for defects in the chain of title of your property. It is a one-time insurance purchase that provides coverage to the landowner (purchaser/buyer) for any situation where the title is not clear, or for which any third party asserts ownership, partial ownership or some other interest in your property. If you are financing and taking a mortgage, title insurance is mandatory in Pennsylvania. If you are cash buyer it is not mandatory, but strongly recommended.

The Limits Of Title Insurance

Title insurance does not cover errors regarding the property boundaries which could come out from a survey, nor does it cover issues related to easements such as those in planned communities. Similarly, it does not cover mechanics’ liens that have not been filed at the time you purchase the policy. For example, if you are buying a newly built home and the builder goes into bankruptcy, title insurance does not cover your losses.
